1. Acceptance of Terms

By accessing and using kickstartmysoccer.com ("Site"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

2. Service Description

KickStart Soccer provides youth soccer training sessions led by experienced young coaches. Our services include:

• Online booking of training sessions
• 45-minute individual or small group training sessions
• Training at various locations in the Lamorinda area
• Support for the American Cancer Society through optional donations

3. User Accounts

3.1 Account Creation

• You must be at least 18 years old or a parent/legal guardian to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities under your account

3.2 Parental Consent

By creating an account and registering a child, you confirm that you are the parent or legal guardian of the child and have the authority to consent to their participation in training sessions.

4. Booking and Payment

4.1 Booking Process

• All bookings are subject to admin confirmation
• Bookings are not final until confirmed by KickStart Soccer administration
• You will receive email confirmation once your booking is approved

4.2 Pricing

• Current session price: $25 per 45-minute session
• Prices are subject to change with notice
• All prices are in USD

4.3 Payment Methods

• Venmo: Payment sent directly to our Venmo account
• Cash: Payment at the training session
• Donation: Tax-deductible donation to American Cancer Society

Payment confirmation by admin is required before sessions. We do not process credit cards or store payment information.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• You may cancel confirmed bookings through your dashboard
• Cancellations cannot be made once a session has started
• You cannot cancel past sessions

5.2 Refund Policy

• If payment was completed: Refunds will be processed for cancelled bookings
• If payment was pending: No refund needed (payment not yet collected)
• Refunds processed via the original payment method (Venmo, cash, etc.)
• Refunds typically processed within 5-7 business days
• Donation-based bookings: Contact American Cancer Society for donation inquiries

5.3 Admin Cancellations

We reserve the right to cancel sessions due to weather, coach unavailability, or other circumstances. If we cancel a confirmed session, you will receive a full refund if payment was completed.

6. Liability and Assumption of Risk

6.1 Assumption of Risk

Soccer training involves physical activity that carries inherent risks. By booking a session, you acknowledge:

• Participation in soccer involves risk of injury
• Your child is physically able to participate
• You have disclosed any relevant medical conditions or special needs
• You assume all risks associated with participation

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KICKSTART SOCCER SHALL NOT BE LIABLE FOR:

• Injuries sustained during training sessions
• Loss or damage to personal property
• Indirect, incidental, or consequential damages
• Damages exceeding the amount paid for the session

You are encouraged to maintain appropriate health/accident insurance for your child.

7. Code of Conduct

By using our services, you agree to:

• Treat coaches and other participants with respect
• Arrive on time for scheduled sessions
• Provide accurate information when booking
• Not misuse or abuse the booking system
• Follow all safety guidelines and instructions from coaches

We reserve the right to refuse service or cancel accounts that violate these terms.

8. Intellectual Property

All content on this Site, including text, graphics, logos, and software, is the property of KickStart Soccer or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

9. Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with or without notice. We will not be liable for any modification, suspension, or discontinuance of the service.

10. Changes to Terms

We may revise these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Contra Costa County, California.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
